Agreement to Our Legal Terms

We are Ascension Point Counselling & Coaching ("Company," "we," "us," "our").

We operate ascensionpoint.co.uk, as well as any other related products and services that refer or link to these legal terms (the "Legal Terms") (collectively, the "Services").

These Legal Terms constitute a legally binding agreement made between you ("you") and Ascension Point Counselling & Coaching, concerning your access to and use of the Services, including booking and attending counselling or coaching sessions. You agree that by accessing the Services, you have read, understood, and agreed to be bound by all of these Legal Terms. IF YOU DO NOT AGREE WITH ALL OF THESE LEGAL TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.

We reserve the right to make changes or modifications to these Legal Terms at any time. We will alert you to changes by updating the "Last updated" date. It is your responsibility to periodically review these Legal Terms to stay informed of updates. Continued use of the Services after changes are posted constitutes acceptance of those changes.

1. Our Services

The information provided when using the Services is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation. Those who choose to access the Services from locations outside the United Kingdom do so on their own initiative and are responsible for compliance with local laws where applicable.

2. Intellectual Property Rights

We are the owner or licensee of all intellectual property rights in our Services, including all source code, website design, text, photographs, and graphics (collectively, the "Content"), as well as our trademarks, logos, and business name (the "Marks").

The Content and Marks are provided "as is" for your personal, non-commercial use only.

Subject to your compliance with these Legal Terms, we grant you a non-exclusive, non-transferable, revocable licence to access the Services and to view or print any portion of the Content to which you have properly gained access, solely for your personal, non-commercial use.

No part of the Services, Content, or Marks may be copied, reproduced, republished, uploaded, distributed, sold, or otherwise exploited for any commercial purpose without our express prior written permission.

3. User Representations

By using the Services, you represent and warrant that: (1) you have the legal capacity to agree to these Legal Terms; (2) you are not a minor in the jurisdiction in which you reside; (3) you will not access the Services through automated or non-human means; (4) you will not use the Services for any illegal or unauthorised purpose; and (5) your use of the Services will not violate any applicable law or regulation.

If you provide information that is untrue, inaccurate, or incomplete, we reserve the right to suspend or refuse current or future use of the Services.

4. Nature of the Counselling and Coaching Relationship

The Services include a website through which you may learn about, enquire about, and book counselling or coaching sessions delivered by Taiba Khan.

Counselling and coaching sessions themselves are delivered in person or online, separately from the website, and are governed by the professional, ethical, and confidentiality standards of the National Counselling and Psychotherapy Society (NCPS), in addition to these Legal Terms.

Nothing on this website constitutes counselling, coaching, medical, or clinical advice. Use of the website, including reading its content, does not create a counselling or coaching relationship. A counselling or coaching relationship begins only once a session has been booked and is being actively delivered.

Confidentiality: what you share during a session is kept confidential, in line with our professional and ethical obligations, except where we are required or permitted by law to disclose information — including where there is a risk of serious harm to you or another person, or where disclosure is required by a court, regulator, or safeguarding authority. Emergency situations: this website and its booking system are not monitored in real time and must not be used to seek urgent or emergency support. If you are in crisis or at risk of harm, please contact emergency services (999), Samaritans (116 123), or your GP.

5. Bookings, Fees and Payment

Session types, durations, and fees are set out on our Services page and may be updated from time to time. The initial consultation is offered free of charge. Ongoing counselling and coaching sessions are charged at the rate stated on the website at the time of booking.

Bookings are made through our online booking system. Ongoing paid sessions are currently arranged directly with Taiba Khan following your initial consultation, rather than through automated online payment.

We reserve the right to correct any pricing errors on the website and will inform you before any session is confirmed if a correction affects your booking.

6. Cancellations and Rescheduling

We ask for at least 48 hours' notice to cancel or reschedule a session.

Cancellations or rescheduling requests made with less than 48 hours' notice, and missed sessions ("no-shows"), will be charged at the full session rate.

Genuine emergencies will be considered on a case-by-case basis, at our discretion.

7. Prohibited Activities

You agree not to:

  • Use the Services for any purpose other than that for which they are made available

  • Attempt to gain unauthorised access to any part of the Services, our systems, or another user's information

  • Use the Services to harass, abuse, or harm another person

  • Interfere with or disrupt the operation of the Services

  • Attempt to reverse engineer, scrape, or systematically extract data from the Services

  • Impersonate another person or misrepresent your identity or affiliation

  • Use the Services in a way that breaches any applicable law or regulation

8. Services Management

We reserve the right to monitor the Services for misuse, restrict or refuse access where these Legal Terms are breached, and take appropriate action, including reporting to relevant authorities where necessary, in order to protect our clients, our practice, and the proper functioning of the Services.

9. Term and Termination

These Legal Terms remain in effect while you use the Services. We reserve the right to deny access to the Services to any person, at our discretion, including for breach of these Legal Terms.

Either party may end an ongoing counselling or coaching relationship at any time; where possible, we ask that this be discussed directly rather than solely through the website.

10. Modifications and Interruptions

We may change, update, or remove content on the Services at any time. We cannot guarantee the Services will be available at all times and are not liable for any inconvenience caused by downtime, maintenance, or technical interruption.

11. Governing Law

These Legal Terms are governed by the laws of England and Wales. Ascension Point Counselling & Coaching and you irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to resolve any dispute arising in connection with these Legal Terms.

12. Corrections

There may occasionally be errors, inaccuracies, or omissions on the Services, including in relation to descriptions or pricing. We reserve the right to correct these at any time without prior notice.

13. Disclaimer

The Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, in connection with the Services, including implied warranties of accuracy or fitness for a particular purpose. We do not warrant that the Services will be uninterrupted, error-free, or secure.

This disclaimer applies to the website and booking system only. It does not limit or exclude any duty of care owed to you as a client during the delivery of an actual counselling or coaching session, which is governed separately by our professional obligations and any liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence.

14. Limitations of Liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, or consequential damages arising from your use of the website or booking system. Our total liability to you for any claim arising from your use of the website or booking system (as distinct from the delivery of counselling or coaching services themselves) will be limited to the lesser of the amount paid by you to us, or £60.

Nothing in these Legal Terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for any other liability which cannot lawfully be excluded or limited under English law.

15. Indemnification

You agree to indemnify us against any loss, damage, or liability arising from your breach of these Legal Terms or your misuse of the Services, except to the extent caused by our own negligence or breach of these Legal Terms.

16. User Data

We maintain certain data you provide through the Services, including booking and contact information, for the purpose of delivering our services to you. Full details of what we collect, why, and how it is stored are set out in our Privacy Policy.

17. Electronic Communications

By using the Services, including making enquiries or bookings, you consent to receive electronic communications from us, and agree that these satisfy any requirement that such communication be in writing.

18. Miscellaneous

These Legal Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding use of the Services. If any provision of these Legal Terms is found unenforceable, the remaining provisions will continue in full effect. These Legal Terms do not create any partnership, employment, or agency relationship between you and us.
